Nevada is a community property state, meaning assets acquired during marriage are generally owned equally by both spouses. Separate property, by contrast, is governed by the intestate succession rules of NRS Chapter 134.

The specific split depends on family structure. If a decedent leaves a spouse and one child, each receives an equal share of the separate property estate. With more than one child, the spouse receives one-third and the children divide the remainder equally.
